Welcome to Cosmaya. These Terms of Service (“Terms”) govern your use of our services, including astrology consultations, readings, website or app access, and any related services (“Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services. 1. Definitions “Client” or “You” means the individual who purchases or uses the Services. “Cosmaya”, “we”, “us”, our means the entity offering Vedic astrology consultations. “Services” means all astrology readings, consultations, horoscopes, predictions, guidance, reports, digital content, or any related service provided by Cosmaya. “Content” means any materials, text, reports, images, charts, audio or video created by Cosmaya or submitted by Client. 2. Scope of Services Cosmaya provides Vedic astrology consultation, which is for guidance, insight, education, and entertainment. The Services do not constitute professional advice in legal, medical, financial, or other regulated fields. Cosmaya makes no guarantee of specific future outcomes, promises, or results. 3. Booking, Payment & Cancellation Client must pay the fees for the chosen Services as per the rates published or agreed upon prior to the consultation. Payment methods accepted will be listed on our website/app. If you cancel or reschedule, you must do so at least 48 hours in advance. Late cancellations may incur a cancellation fee of [percentage]% of the fee or non-refundable deposit (specify). Cosmaya reserves the right to cancel or reschedule a consultation due to unforeseen circumstances; if so, we will notify you and provide a new time or refund. 4. Delivery of Services Consultations may be delivered in person, via video call, audio call, chat, or via reports, depending on what is purchased. Cosmaya will use reasonable efforts to deliver Services on time; delays may happen, but you will be informed. Client must provide accurate details (name, date of birth, time of birth, place of birth) for the astrology reading. Inaccurate or incomplete info may affect the quality and accuracy. 5. Accuracy, Disclaimers & Limitations Astrology is a belief system; interpretations are subject to various influences and should not be regarded as certain. Cosmaya disclaims any liability for actions taken by Client based on readings or guidance. The Client is responsible for using their own judgment for decisions; Cosmaya is not responsible for outcomes. 6. Intellectual Property All materials, reports, charts, audio/video content produced by Cosmaya are the intellectual property of Cosmaya. Client is granted a non-exclusive, non-transferable license to use the content for personal, private use only. Client may not reproduce, distribute, sell, adapt, or publicly use Cosmaya’s content without written permission. 7. Privacy Cosmaya collects personal data (e.g. name, birth details, time, place) as required for astrology readings. We will handle your personal data in accordance with our Privacy Policy. (Include a separate Privacy Policy, which covers collection, storage, processing, retention, sharing, rights of user, etc.) Data security measures will be in place, but Cosmaya is not responsible for unauthorized access due to factors outside our control. 8. Refunds If you are not satisfied, you must contact Cosmaya within 2 days after delivery of the Service to request a review or refund. Refunds will be at Cosmaya’s discretion, possibly partial, depending on what portion of the Service has been delivered. No refunds are given for non-attendance without prior cancellation or where the Session has already taken place. 9. Client Obligations Client agrees to provide accurate, truthful, complete information to enable proper readings. Client agrees not to misuse the Services (for example, harassment, defamation, illegal acts). Client should ensure confidentiality of any shared credentials (if relevant) and respect intellectual property. 10. Limitation of Liability To the fullest extent permitted by law, Cosmaya’s liability is limited to the amount you paid for the particular Service giving rise to liability. Cosmaya is not liable for indirect, incidental, special, consequential, or punitive damages or loss (e.g., loss of profits, psychic harm, etc.). 11. Indemnification You agree to indemnify, defend, and hold harmless Cosmaya, its affiliates, partners, and employees from any claims, damages, liabilities, costs or expenses (including legal fees) arising from your breach of these Terms or your misuse of the Services. 12. Intellectual Honesty & Ethics Cosmaya aims to practice ethically: no guarantee of “miracle cures” or guaranteed outcomes. We do not intentionally promote fear-mongering, misinformation, or false claims. If Client is under legal age (as per local laws), consent of a parent/guardian is needed. Upon termination, Client must cease using Cosmaya’s content and return or destroy it if requested. 13. Dispute Resolution & Governing Law These Terms are governed by the laws of [Your Jurisdiction, e.g. Maharashtra, India]. Any dispute shall first be attempted to be resolved by good faith negotiation. If unresolved, disputes may be submitted to mediation/arbitration or the courts in [City, State]. 14. Changes to Terms Cosmaya reserves the right to modify these Terms at any time. When we do, we will post the updated Terms with a new “Last Updated” date. Continued use of Services after changes constitutes acceptance of the modified Terms. 15. Miscellaneous Severability: If any provision is held invalid or unenforceable, that provision will be modified or severed, and the rest will remain in full effect. Waiver: No failure or delay by Cosmaya in enforcing any right under these Terms will be a waiver of that right. Assignment: Cosmaya may assign or transfer its rights under these Terms; Client may not assign rights without Cosmaya’s consent.
